Arkansas Decriminalizes CBD in Food Despite Ongoing Federal Prohibition

Overview: Arkansas Gov. Asa Hutchinson signed a bill into law that decriminalizes hemp-derived cannabidiol. This will not only open up markets in Arkansas, but it is also a crucial step given the FDA’s continued regulation of CBD.
The NEW law removes hemp-derived cannabidiol that is not approved by the United States Food and Drug Administration for marketing as medication from the state’s list of controlled substances. This effectively removes all criminal and civil penalties for possessing hemp-derived CBD products in Arkansas. Passage of HB1518 ensures the state will not regulate CBD and CBD products.
