Colorado Law Expands Asset Forfeiture Reforms

Overview: A new Colorado law went into effect expanding asset forfeiture reporting requirements instituted in 2017. The legislation expands asset forfeiture reporting requirements by redefining the agencies required to submit reports.

The previous law required “seizing agencies” to submit extensive forfeiture reports. Under HB1020, any “reporting agency” defined as “any state or local entity that employs a person, other than a judge or magistrate, who is authorized to effectuate a forfeiture of real or personal property” will now have to submit reports. The new law also specifically includes the office of a district attorney and local law enforcement agencies. This broader definition will ensure all agencies involved in the forfeiture process are included in the reporting requirements.

Colorado Opts Out of Federal Asset Forfeiture Program in Most Situations

Overview: A Colorado law went into effect on August 9, 2017, taking an important first step toward closing a federal asset forfeiture loophole.

The legislation primarily created an extensive reporting system related to asset forfeiture that law enforcement agencies now must follow. But important provisions in the new law required the state to stop participating in a lucrative federal asset forfeiture program in a vast majority of situations.
