Colorado Creates State Process to End Qualified Immunity for Police

Overview: Titled the Law Enforcement Integrity Act, the new law makes several reforms related to law enforcement, including creating a cause of action in state courts to sue police officers when they infringe on “any constitutional right secured by the bill of rights of the Colorado constitution.” The law specifically states that qualified immunity “is not a defense” to such civil action. The new law institutes a number of other policies including mandatory police body-cams and rules for their use. It also implements detailed reporting requirements for police use of force, prohibits police from engaging in certain actions during protests or demonstrations, and implements use of force standards for Colorado police. Other provisions will be enacted in September. Body cams will be required beginning July 1, 2023.
