Colorado Limits Government Use of Facial Recognition

Overview: Colorado Gov. Jared Polis signed a bill that places some limits on the use of facial recognition technology. The new law will not only help protect privacy in Colorado; it could also hinder one aspect of the federal surveillance state.
The law prohibits Colorado law enforcement agencies from engaging in ongoing surveillance, conducting real-time or near real-time identification, or from starting persistent tracking using facial recognition without a warrant in most situations. In order to obtain a warrant, police must first establish probable cause and show that the use of facial recognition is necessary to develop leads in an investigation.
SB113 does allow the use of facial recognition with a court order to locate a missing person or to identify a deceased individual.
