Illinois Marijuana Legalization Now in Effect Despite Federal Prohibition

Overview: An Illinois law legalizing marijuana for recreational purposes goes into effect, despite federal prohibition on the same.

Additionally, under the new law nearly 800,000 people with criminal records for purchasing or possessing 30 grams of marijuana or less may have those records expunged. The governor will pardon past convictions for possession of up to 30 grams, with the attorney general going to court to expunge or delete public records of a conviction or arrest. For possession of 30 to 500 grams, an individual or a state’s attorney may petition the court to vacate and expunge the conviction, but prosecutors may object, with a judge to make the final decision.

Illinois Expands Medical Marijuana Program Despite Federal Prohibition

Overview: Illinois Gov. J.B. Pritzker has signed a new bill into law that expand the state’s medical-marijuana program despite federal prohibition.

Senate Bill 2023 (SB2023) was originally a marijuana banking bill that would have prohibited state banks from denying certain services to marijuana businesses. During the legislative process, that language was scrapped and the bill was amended to expand and make permanent the state’s medical-marijuana pilot program. The program was slated to sunset next year.

SB2023 adds 11 new conditions eligible for treatment with medicinal cannabis. The new law also allows qualifying veterans to access medical marijuana as part of an Opioid Alternative Pilot Program. Under the new law, advance practice registered nurses and physician assistants will now be able to recommend medical marijuana. Under the pilot program, only physicians could certify patients.
