Maine Law Limits Government Use of Facial Recognition

Overview: A Maine law limiting government use of facial recognition technology in the state went into effect on October 1, 2021. The growing movement to prohibit the use of facial recognition at the state and local levels can hinder the operation of a growing national facial recognition network.

The new law bans public employees and officials, including law enforcement officers, from obtaining, retaining, possessing, accessing, or using a facial surveillance system or information derived from a facial surveillance system with some exceptions. It also bans state agencies from entering into agreements with third parties to obtain facial recognition information. An amendment approved in the Joint Committee on Criminal Justice and Public Safety allows police to use facial recognition in the investigation of a few serious crimes, including murder and rape. An amendment also excluded iris scans from the ban.

Portland, Maine Voters Approve Measure to Ban Government Use of Facial Recognition Technology

Overview: Voters in Portland, Maine, approved a measure to ban government use of facial recognition technology in the city. The growing movement to prohibit the use of facial recognition at the state and local levels could hinder the operation of a growing national facial recognition network.

Under the law, “No city official or employee shall obtain, retain, access, or use any facial recognition technology or information provided by any facial recognition technology.” The Portland City Council passed a similar measure in August, but it didn’t have any enforcement mechanism. The ballot measure will replace the council version and cannot be repealed for five years. Under the law, any person who proves they were surveilled in violation of the law can collect a minimum of $1,000 in civil fees. The ordinance also includes a process for suspending or terminating city employees who violate the law.
