New Mexico Law Creates Process to Expunge Some Marijuana Charges

Overview: Under House Bill 2 (HB2), adults 21 and over can possess up to 2 ounces of marijuana, 16 grams of cannabis concentrates, and 800 milligrams of infused edibles. The law also allows home cultivation of up to six plants per person for personal use with a limit of 12 plants per household.
The new law creates a regulatory structure for commercial cultivation and retail sales of marijuana in the state.
With Gov. Michelle Lujan Grisham’s signature on April 12, the law went into effect as of June 29, 2021. Retail marijuana sales will begin no later than April 1, 2022
New Mexico Law Creates Process to Expunge Some Marijuana Charges

Overview: New Mexico Gov. Michelle Lujan Grisham signed House Bill 370 (HB370), a bill that makes it easier for people with marijuana charges on their records to have them expunged.
Under the new law, persons convicted of a misdemeanor can petition to have their records expunged two years after completing their sentence. Individuals with felony convictions will have to wait six years prior to petitioning the court.
New Mexico Loosens State Marijuana Laws Despite Federal Prohibition

Overview: New Mexico Gov. Michelle Lujan Grisham signed two bills into law that loosen state prohibitions on marijuana.
The new law decriminalizes possession of small amounts of marijuana. Under the new statute, possession of up to a half-ounce of cannabis will no longer be a criminal offense. Instead, it will be a petty misdemeanor with a fine of $50 for the first offense. The new law also decriminalizes marijuana paraphernalia possession.
New Mexico Law Expands Medical Marijuana Program Despite Federal Prohibition

Effective Date: 7/1/2019
Overview: A New Mexico law expanding the state’s medical marijuana program went into effect despite federal prohibition. The new law will further nullify federal cannabis prohibition in effect within the borders of the state.
Under the new law, marijuana patients registered in other states will be able to participate in New Mexico’s program. It also allows medical cannabis use on school campuses under defined circumstances and extends the registration renewal period from one to three years. Finally, the new law will allow for licensed medical marijuana establishments to create “consumption areas,” subject to approval by the department of health.
