New Mexico Law Creates State Process to End Qualified Immunity

Effective Date: 7/1/2021
Overview: The law creates a cause of action in state courts to sue state or local government agencies when their employees or officials “subject or cause to be subjected any resident of New Mexico or person within the state to deprivation of any rights, privileges or immunities secured pursuant to the bill of rights of the constitution of New Mexico.” HB4 specifically excludes qualified immunity as a defense in such cases.
In practice, an individual can now pursue damages or injunctive relief under the law without the qualified immunity barrier, but they can not directly hold individual agents accountable. That will be left to the employing agency.
