North Carolina Law Expands Right to Try Act, Rejects Some FDA Restrictions

Overview: A North Carolina law expanding the state’s Right to Try act went into effect. The expanded provisions allow certain patients to access stem cell treatments not yet given final approval by the FDA, nullifying some agency regulations in effect.

The legislation authorizes the use of certain investigational adult stem cell treatments for patients with certain terminal or chronic illnesses under the state’s Right to Try law. H934 includes language to protect physicians who recommend investigational stem cell treatments.

The law also prohibits any state or local government agency or employee from interfering with an eligible patient’s access to an experimental stem cell treatment.

North Carolina Right to Try Law Taking on Some FDA Restrictions Goes into Effect

Overview: The new “Right to Try” law sets the state to nullify in practice some Food and Drug Administration (FDA) rules that stop terminally ill patients from utilizing certain treatments by allowing them to access experimental medications and procedures not yet approved by the federal regulatory agency.

House Bill 652 (H652) gives terminally ill patients access to medicines that have not received final approval for use by the FDA. The law also provides protection to health care providers, with a prohibition against revoking a license or issuing sanctions based on recommendation or issuance of such investigational treatments. The law also shields them from lawsuits.
