Virginia Marijuana Legalization Now in Effect Despite Federal Prohibition

Overview: A Virginia law legalizing adult-use marijuana went into effect despite ongoing federal cannabis prohibition.
Under the law, adults 21 and older can purchase and possess up to 1 ounce of marijuana and cultivate up to four plants without penalty. The legislation also creates a regulatory scheme for the commercial cultivation and retail sale of cannabis. The law establishes an independent agency called the Virginia Cannabis Control Authority to establish a regulatory structure for the adult-use market. The bill includes provisions to create a process for the expungement of records relating to past marijuana crimes.

Under the old law, possession of a half-ounce or less is punishable by up to 30 days in jail and a $500 fine. Possession of hash and other concentrates is a felony.
The legislation also includes provisions to seal the records of past and future marijuana convictions and bars most employers from asking about marijuana convictions in the hiring process.

Two Virginia Bills Expand State’s Medical Marijuana Program

Overview: Virginia Gov. Ralph Northam signed two bills into law that expand the states medicinal cannabis program. Enactment of this law takes another step toward nullifying federal marijuana prohibition in effect.
The new law allows medical marijuana patients to designate another person to act as their registered agents for the purposes of receiving medicinal cannabis. This will make it easier for patients in rehabilitation centers, hospice, or those physically unable to drive to obtain medical marijuana. The new law also expands the pool of people authorized to perform marijuana cultivation-related duties.

Overview: Virginia Gov. Ralph Northam signed two bills into law that expand the states medicinal cannabis program. Enactment of this law takes another step toward nullifying federal marijuana prohibition in effect.
Under the new law, licensed physician assistants and licensed nurse practitioners will be authorized to issue a written certification for the use of medicinal cannabis. Under the current law, only licensed physicians can issue the certifications.
