Current Law

California Law Bans Facial Recognition on Police Body Cameras

Overview: A California law banning police from using facial recognition and biometric scanners with police officer cameras for the next three years went into effect on January 1, 2020. The law has already had a significant practical impact on the surveillance state.

The new law prohibits a law enforcement agency or law enforcement official from installing, activating, or using any biometric surveillance system in connection with an officer camera or data collected by an officer camera. This includes body-worn and handheld devices. Before the final Senate vote, that chamber amended the bill twice to make the provisions temporary. With the initial amendment, the law would have been automatically repealed on Jan. 1, 2027. A second amendment whittled that backed to 2023. So in effect, AB1215 institutes a 3-year ban on facial recognition combined with police officer cameras.

Oakland City Council Bans Facial Recognition

Overview: The Oakland City Council gave final approval for a ban of facial recognition technology by the city. The new ordinance not only increases privacy in Oakland; it also takes a step toward limiting a massive federal surveillance program.

The ordinance prohibits Oakland government agencies, including police, from “acquiring, obtaining, retaining, requesting, or accessing” facial recognition technology. The ban includes accessing information obtained through facial recognition technology used by agencies outside of the city. The ordinance defines facial recognition as “an automated or semi-automated process that assists in identifying or verifying an individual based on an individual’s face.”
