Delaware Expands Medical Marijuana Program Despite Federal Prohibition

Overview: Delaware Gov. John Carney signed a bill into law that expands the state’s medical marijuana program despite ongoing federal cannabis prohibition.

The new law will expand access to medical marijuana by allowing nurse practitioners and physician assistants to recommend medicinal cannabis for qualifying patients over the age of 18. Under the old law, only physicians could recommend medical marijuana.

Patients under 18 will still have to get a recommendation to use medical marijuana from a physician specializing in pediatric medicine.

Delaware Bill Expands Marijuana Decriminalization Despite Federal Prohibition

Overview: Delaware Governor John Carney signed a bill to decriminalize marijuana possession by minors in the state despite federal prohibition.

Delaware decriminalized the possession or consumption of a “personal-use quantity” of marijuana for adults 21 or over in 2015, making it a civil violation subject to a fine. But under that law, possession of a personal-use quantity of cannabis remains a criminal offense for people under the age of 21. Enactment of SB45 expands decriminalize of personal use consumption or possession of marijuana to include individuals under 21.

Overview: Delaware Gov. John Carney signed a bill expanding the state’s medical marijuana program and a bill creating a process to expunge the sentences of people charged under the state’s marijuana laws prior to decriminalization. These two laws take further steps toward nullifying federal marijuana prohibition in effect in Delaware.

The the new law adds glaucoma, chronic debilitating migraines, pediatric autism spectrum disorder, and pediatric sensory processing disorder to the list of qualifying conditions for medical marijuana in the state.

Overview: Delaware Gov. John Carney signed a bill expanding the state’s medical marijuana program and a bill creating a process to expunge the sentences of people charged under the state’s marijuana laws prior to decriminalization. These two laws take further steps toward nullifying federal marijuana prohibition in effect in Delaware.

The new law provides mandatory expungement eligibility to individuals who were convicted of misdemeanor possession, use or consumption of marijuana prior to Delaware’s decriminalization of these offenses. To be eligible for the mandatory expungement, the marijuana conviction must be the applicant’s only criminal conviction, and it does not apply to charges that were reduced from more serious felony offenses.
