New Hampshire Expands Medical Marijuana Program Despite Federal Prohibition

Overview: New Hampshire Gov. Chris Sununu signed a bill into law expanding the state’s medical-marijuana program despite ongoing federal cannabis prohibition.
The new law authorizes physicians to recommend medical marijuana for patients with moderate or severe insomnia. It also allows adult or pediatric patients with autism spectrum disorder (ASD) to use medical marijuana under specific circumstances, despite an ongoing federal prohibition on the same.
New Hampshire Bill Creates Process to Expunge Some Marijuana Charges

Overview: New Hampshire Gov. Chris Sununu signed a bill to create a process to expunge certain marijuana charges form people’s records.
Under the law, any person arrested or convicted on or before Sept. 16, 2017, for “knowingly or purposely obtaining, purchasing, transporting, or possessing, actually or constructively, or having under his or her control, 3/4 of an ounce of marijuana or less,” can petition the court to have their arrest record and/or court record annulled.

Overview: A law decriminalizing marijuana possession in New Hampshire went into effect. The legislation eliminates criminal penalties for simple marijuana possession by “allowing offenders to pay fines by mail will result in less time and resources spent on such cases, allowing police and courts to spend more time and resources dealing with serious crimes.”
HB640 changes possession “of 3/4 ounce or less of marijuana or 5 grams or less of hashish” from a criminal misdemeanor to a civil infraction punishable by “a minimum of $350 for a first offense and $500 for a second or subsequent offense.” Any New Hampshire resident possessing “more than 3/4 ounce of marijuana or more than 5 grams of hashish” will now be charged with a criminal misdemeanor, rather than a felony.

Overview: Governor John Sununu signed two bills into law that will expand the state’s medical marijuana program. These measures further nullify the federal prohibition on cannabis in practice in the state.
The legislation expanded the state’s medical marijuana program. HB157 adds chronic pain to the list of qualifying conditions for patients to receive medical marijuana, and HB160 allows individuals with post-traumatic stress disorder to access medical marijuana.

Overview: A law expanding New Hampshire’s medical marijuana program went into effect. This will build on the already existing nullification of federal marijuana laws in the Live Free or Die state.
Rep. Eric Schleien (R-Hillsborough) sponsored House Bill 157 (HB157) to add chronic pain to the list of qualifying conditions for patients to receive medical marijuana. It was signed into law by Gov. John Sununu on Jun. 16, 2017, and it officially went into effect on Aug. 15.
“There’s been a lot of research on this which shows that doctors prescribe fewer opioids in states where medical cannabis is an option for pain, and those states have lower fatal overdose rates,” Rep. Schleien said in a written statement defending his reform. Allowing patients who suffer from this condition to access medical marijuana further expands the medicinal cannabis program in New Hampshire.

Overview: An expansion of the state’s medical marijuana law went into effect, further nullifying federal prohibition in practice.
The legislation adds ulcerative colitis to the list of debilitating medical conditions that qualify a patient to access medicinal cannabis under the state’s medical marijuana law. This is the second time the New Hampshire legislature has expanded the conditions eligible for treatment with medicinal cannabis.The state legalized marijuana for medical use in 2013. Allowing patients suffering from ulcerative colitis to access medical marijuana will further expand the medicinal cannabis program in New Hampshire.
New Hampshire Law Broadens Medical Marijuana Program

Overview: New Hampshire Gov. Maggie Hassan signed a bill into law that expands the state’s current medical marijuana program, further nullifying in practice the federal prohibition on the same.
Introduced by Rep. Stephen Schmidt (R-Wolfeboro) and five bipartisan co-sponsors, House Bill 476 (HB476) adds “epilepsy, lupus, Parkinson’s disease, [and] Alzheimer’s disease” to the list of qualifying conditions for medical marijuana in the state of New Hampshire. None of these conditions are exceptions to the blanket prohibition on marijuana under federal law. But that didn’t stop advocates in New Hampshire. HB476 was signed into law on July 6, 2015 and it went into effect on September 4.
